<p style="font-size:18px"><strong>守德市( T.P Thu Duc  )首添歌劇院興建案由於未獲撥興建經費而被迫延後動工，恐怕難以按計劃在2024年完工</strong></p>

<p style="font-size:16px">據胡志明市民用暨工業建設投資項目管理委員會表示，由於受到疫情影響，市府為緩解疫情對民生及產業之衝擊，優先啟動各項民生和刺激經濟項目，故守德市( T.P Thu Duc  )首添歌劇院( Nha Hat Thu Thiem  )興建案不屬2021-2025年公共投資預算分配優先項目。歌劇院的興建由於未獲得撥經費而因此被迫延後動工，恐怕也難以照計劃在2024年完工。</p>



<p style="font-size:16px">首添歌劇院興建案於2018年10月獲胡志明市議會( <a href="https://hdnd.hochiminhcity.gov.vn/home" target="_blank" rel="noreferrer noopener">HĐND TP HCM</a> ) 批准通過，總經費逾15,000億越盾（後來提出增加至近20,000億越盾）。根據當時計劃，工程將在2021-2022年完工，但之後完工時間調整為2024年。歌劇院有一大一小共兩廳，座位數共1,700席，並經跨越西貢河之人行天橋連接第1郡的阮惠街行人廣場。</p>

<p style="font-size:16px">歌劇院興建案當初獲批准通過時，社會輿論表示，胡志明市還有很多問題需要解決，如淹水、交通堵塞等，認為民眾迫切需要的並非是興建歌劇院。</p>

<p style="font-size:16px">胡志明市稅務局( <a href="https://www.hcmtax.gov.vn/" target="_blank" rel="noreferrer noopener">Cục Thuế TP.HCM</a> )於4月7日上午收到<a href="https://vneconnews.com/%e5%ae%88%e8%ac%99%e6%96%b0%e5%b8%82%e5%8d%804%e7%ad%86%e3%80%8c%e9%bb%83%e9%87%91%e5%9c%9f%e5%9c%b0%e3%80%8d%e6%8b%8d%e8%b3%a3%e9%87%91%e9%a1%8d%e5%90%88%e8%a8%88%e9%80%be37%e8%90%ac%e5%84%84/" target="_blank" rel="noreferrer noopener">之前得標守謙新市區「黃金土地」的2家公司</a>，Dream Republic和Sheen Mega的公司函。2家公司希望能延長土地使用費及包括滯納金等其他費用的繳納日期至今( 2022 ) 年9月份，且分6期來繳納，4月份先繳納15%，5、6、7、8月份每月繳納17%，9月份則繳納全部剩餘金額。</p>

<p style="font-size:16px">但據稅務局代表表示，企業提出的理由不屬於符合延長繳納期限條件。因此，胡志明市稅務局仍將繼續依規定收取滯納金。之前，稅務單位在3/21日曾提醒這2家公司有關繳納土地使用費問題。 兩家企業的代表表示，正在努力集資，並承諾盡快完成繳納土地使用費。</p>

<p style="font-size:18px"><strong>Binh Minh公司是第2家請求棄標守謙新市區「黃金土地」的得標公司</strong></p>

<p style="font-size:16px">據前鋒報報導，胡志明市稅務局( <a href="https://www.hcmtax.gov.vn/" target="_blank" rel="noreferrer noopener">Cục Thuế TP.HCM</a> )局長Le Duy Minh在2月8日表示，該局已收到Binh Minh投資發展貿易有限公司( Công ty Bình Minh  )請求棄標不久前才得標，位於守謙新市區( Thu Thiem ) 標記3-9的一筆「黃金土地」的相關文件。</p>



<p style="font-size:16px">Binh Minh公司在2021年12月10日與其他13家公司參與競標的，最終以50,260億越盾標得標記為3-9的該筆土地，得標價是起價的6.9倍。該公司表示，由於公司的營運受到COVID-19( 新冠肺炎 ) 疫情衝擊，導致公司沒有足夠資金來投資在之前得標的該筆土地。</p>

<p style="font-size:16px"><a href="https://tanhoangminh.com.vn/" target="_blank" rel="noreferrer noopener">Tan Hoang Minh集團</a>代表1月11日晚上向VnExpress電子報透露，該集團主董事長Do Anh Dung已去函越南總書記Nguyen Phu Trong和黨國領導，請求棄標不久前以超高價得標<strong>，</strong>位於守謙新市區( Thu Thiem ) 標記為3-12的一筆「黃金土地」。Do Anh Dung董事長表示，願意承擔單方面終止合約的所有法律責任。 </p>



<p style="font-size:16px">Do Anh Dung董事長表示，集團在聽取財政部長Ho Duc Phuc在1月4日稱: &#8220;以每平方米24.5億越盾得標是不尋常&#8221;之後，亦認為以每平方米24.5億越盾的超高價得標可能會給市場帶來諸多不確定性。因此，為了確保房地產市場的穩定<strong>，</strong>所以決定棄標 。</p>

<p style="font-size:16px"><a href="https://vneconnews.com/%e7%84%a1%e6%b3%95%e7%b9%b3%e7%b4%8d%e5%9c%9f%e5%9c%b0%e4%bd%bf%e7%94%a8%e8%b2%bb-%e6%88%bf%e7%94%a2%e4%bc%81%e6%a5%ad%e4%b8%8d%e7%88%bd/" target="_blank" rel="noreferrer noopener">胡志明市不動產協會</a>（HoREA）早在2018年就向建設部( <a href="http://www.moc.gov.vn/" target="_blank" rel="noreferrer noopener">Bộ Xây dựng</a> )報告有關短期租賃業務的新經營模式，透過Airbnb服務等以“共享房間出租”的形式在經營，而《 2014年房屋法》和《 2014年不動產經營法》尚未有相關的法令規範。根據Grant Thornton在2019年進行的一項調查，透過Airbnb來經營“共享房間出租”業務在越南正迅速發展中，目前共有約30,000個住宿單位參與。</p>

<p style="font-size:16px">HoREA表示，根據《 2014年房屋法》第6條第11款規定，禁止“將公寓使用於居住以外的目的”，但是“將公寓使用於居住以外的目的”法條文字字義不夠清楚，且該法第10條又規定“房屋擁有者有權利將房屋出租”， 第121條規定“出租人和承租人可就租賃期限自行協議”，亦即也包括短期租賃? 為避免舊法規跟不上新的商業模式，HoREA提供國外管理“ Airbnb共享房間出租”方式的經驗給政府做參考，如須向地方政府註冊登記和繳納稅，只能在一年中的特定期間內做短期出租等 …</p>



<p>HoREA 提議政府修訂《 2014年房屋法》和《 2014年不動產經營法》以便讓短租正式合法化。</p>

<p style="font-size:16px">政府辦公室剛剛發布指示公文，公文傳達有關總理對加速發給土地使用權證和房屋權狀的指示。 指示內容表示，如像媒體所報導的，<a href="https://vneconnews.com/%e7%84%a1%e6%b3%95%e7%b9%b3%e7%b4%8d%e5%9c%9f%e5%9c%b0%e4%bd%bf%e7%94%a8%e8%b2%bb-%e6%88%bf%e7%94%a2%e4%bc%81%e6%a5%ad%e4%b8%8d%e7%88%bd/" target="_blank" rel="noreferrer noopener">因建案還無法繳納土地使用費而導致購屋民眾遲遲無法拿到產權的話</a>，胡志明市政府應盡快協調各相關部會來提出解決方案，加速發給購屋者土地使用權證及房屋權狀。</p>

<p style="font-size:16px">事情發生的原因是由於<a href="https://vneconnews.com/%e7%84%a1%e6%b3%95%e7%b9%b3%e7%b4%8d%e5%9c%9f%e5%9c%b0%e4%bd%bf%e7%94%a8%e8%b2%bb-%e6%88%bf%e7%94%a2%e4%bc%81%e6%a5%ad%e4%b8%8d%e7%88%bd/" target="_blank" rel="noreferrer noopener">購屋者</a>反映該建案ST5區（Dahlia Homes &#8211; ST5）的聯排住宅、別墅面積短少13-20平方米， ST5區買戶還表示，開發商費自行把管理費從每平米7,700越盾任意提高到每平米11,000越盾。 此外，買戶還反對公司要求要先繳5千萬越盾押金才可以進房屋裝修， 特別是，買戶還表示開發商在建案基礎設施未完成就交屋等&#8230;雙方經多次協商失敗後，多名買戶通知Gamuda Land Việt Nam將暫停支付第六期款項（2020/06/03日到期）直至以上問題得到解決。</p>

<p style="font-size:16px">買戶進一步表示，Gamuda Land Việt Nam在糾紛還沒得到解決就已書面通知兩名購屋者要終止買賣契約 。而根據Gamuda Land Việt Nam的說法，終止雙方買賣合約的原因是因公司多次提醒這兩位買戶繳納第6期（2020/06/30日到期）和第7期（2020/07/31日到期）款項但買戶都不理會，至今已逾期超過30天，因此，購屋者已嚴重違反《買賣契約》中的條款，對公司造成損害。</p>



<p style="font-size:16px">ST5區（Dahlia Homes &#8211; ST5）買戶在收到金務大置地(越南)書面通知後非常不滿的表示，雙方自簽訂房屋買賣契約以來，他們都按合約分期支付款項。 但是當交屋時，買戶發現諸多問題並向開發商提出補救措施後，並以書面通知金務大置地( 越南 )將暫停支付款項直至問題得到解決，而在買戶所提建議尚未得到回應時，金務大置地(越南)就單方做出收回已出售的房屋決定是違反買賣契約的。</p>

<p style="font-size:16px">據知，在面對客戶的強烈反彈下，雙方經2020/09/10日的協商後，Gamuda Land Việt Nam 同意把收回房屋的時間延長至2020年9月21日，並同時重申，雙方在此期間可就全部懸而未決的問題達成協議， 如無法達成協議，Gamuda Land Việt Nam將根據已簽訂之房屋買賣合約來行使公司的權利。</p>

<p style="font-size:16px">由青年報（<a rel="noreferrer noopener" href="https://thanhnien.vn/" target="_blank">Báo Thanh Niên</a>）近期舉辦的座談會上，與會的胡志明市不動產協會（<a rel="noreferrer noopener" href="http://www.horea.org.vn/" target="_blank">HoREA</a>）主席Le Hoang Chau表示，今年前8個月胡志明市政府收取的土地使用費比去年同期減少52％。 全市目前有54個建案還無法繳納土地使用費，且有超過25,000間公寓尚未獲得發給房屋權狀( 粉紅皮書 )。Chau先生認為，企業一直無法繳納土地使用費將帶來許多嚴重的後果。具體包括，投資開發商無法幫購屋者申辦房屋權狀( 粉紅皮書 )，開發商無法收取交屋後剩餘的5％尾款等。導致購屋者不滿，且開發商也信譽受損。</p>



<p style="font-size:16px">與會的房產企業代表也表示不滿，Hung Thinh集團( <a href="https://hungthinhcorp.com.vn/" target="_blank" rel="noreferrer noopener">tập đoàn Hưng Thịnh</a> )副總經理陳國勇( Trần Quốc Dũng )無奈表示，儘管營建許可和驗收合格等相關文件都齊全，但該集團目前有13個建案，其中近9,000戶公寓尚未獲得發給房屋權狀( 粉紅皮書 ) 。<a href="https://www.novaland.com.vn/" target="_blank" rel="noreferrer noopener">Novaland Group</a>總經理Bui Xuan Huy亦表示，不單是Hung Thinh集團，Novaland在胡志明市開發40多個建案，其中11個至今仍無法繳納土地使用費。另外還有其他房產公司，如 Sơn Kim Land等&#8230;也面臨同樣困境。</p>

<p style="font-size:16px">而與會的胡志明市環境暨資源所( <a href="http://www.donre.hochiminhcity.gov.vn/" target="_blank" rel="noreferrer noopener">Sở TNMT TP HCM </a>)副理Tran Van Thach承認，表示目前解決建案的土地使用費問題進度緩慢。Thach先生進一步表示說  “大型建案的開發時間通常會持續多年，而在此期間，法規和政策常有修改，建案本身也常無法避免有所調整，導致計算土地使用費時出現問題”。Thach先生補充說，今年前6個月，已經有38個建案的土地使用費問題得到解決，且不久還會有49個建案會得到解決。目前還有超過300個建案遇到無法繳納土地使用費問題。</p>
